New Mexico law mandates that anyone in the state that has been convicted of a DWI receive an Ignition Interlock License and install an Ignition Interlock Device on every vehicle driven by them. This includes those charged with a DWI for the first-time.
How do I apply for an Ignition Interlock License in New Mexico?
According to the New Mexico Motor Vehicle Division (MVD) website, if you are arrested for DWI in New Mexico, your license will be confiscated on the spot if your breath test is at or above the legal limit (0.08% for drivers over 21 and 0.02% for drivers under 21), or if you have refused to take the test. This is called an administrative revocation, and it is separate from any criminal charges you may face.
If your license is revoked, you can apply for an Ignition Interlock License. You can get an Interlock License at any State MVD field office. The annual fee for the license is $113.00. To apply, you must have proof of identification, an Ignition Interlock contract from an authorized provider, proof of insurance and a notarized MVD Ignition Interlock Affidavit.
New Mexico Ignition Interlock Indigent Fund
The New Mexico Department of Transportation (NMDOT) Traffic Safety Division administers a legislatively mandated Ignition Interlock indigent fund to provide financial aid to those required to install an Interlock device in their vehicles that cannot afford it. If you qualify, the NMDOT Traffic Safety Division may pay for one vehicle per person, up to: $50.00 for the cost of installation; $30.00 monthly for verified active usage of the Interlock Device, and up to $50.00 for the cost of removal. You may be responsible for all other charges associated with the installation, servicing and removal of the Ignition Interlock Device.
