How do you get your license back in Oregon after a DUII?

According to the Oregon DMV, drivers convicted of first-offense DUII are subject to a one-year license suspension as a criminal penalty, as well as a separate “implied consent” suspension of 90 days to a year from the DMV.

Understanding Oregon DUII Requirements

Basic OUI Requirements

We know that navigating a DUII can be overwhelming. Understanding the requirements and process after an alcohol related driving offense in Oregon is an important step to getting back on the road. We’ve put together some general information to help you get started.

Under Oregon law, a driver charged with a first-offense DUII can be subject to all of these penalties:

  • Minimum fine of $1,000
  • License suspension for one year
  • Either a minimum of 48 hours imprisonment or community service
  • Undergo a drug and alcohol screening with an Oregon Alcohol and Other Drug Screening Specialist (ADSS)
  • Participate in a DUII treatment program 

Fines, suspension periods, and imprisonment sentences are often higher for drivers whose DUII charge includes aggravating circumstances, such as driving with a passenger under 18 or having previous DUII offenses on their record. 

The Oregon DMV can also suspend your license separately under Oregon’s implied consent laws. For a first offense, the DMV can issue a minimum 90-day suspension, or a one-year suspension for drivers with no previous DUIIs who refuse a blood test.

License Reinstatement

You may be able to request a hardship permit from the Oregon DMV while your license is suspended, which allows you limited driving privileges for driving to work, medical appointments, child care, and other essential activities. To apply for a hardship permit, you’ll submit the application paperwork along with a $75 application fee and an $85 reinstatement fee. A hardship permit isn’t available to some drivers, typically including drivers with multiple DUII charges.

If you receive a hardship permit, you’ll be required to install an Ignition Interlock Device on your vehicle. According to the Oregon DMV Suspensions and Cancellations resource page, you’ll have to submit a 90-day No-Negative Report at the end of your required installation period. This certifies that you haven’t received an IID violation in 90 days. If you have recent violations, you must keep the IID installed until you can provide this report.

Whether or not you apply for a hardship permit, you’ll be required to install an Interlock Device for a specified period of time when your suspension ends and obtain SR-22 insurance coverage. For most people with a first-offense DUII, the IID requirement period will last for one year. 

Finally, when you’ve completed the conditions of your DUII program, call the Oregon DMV at 503-945-5037 or go to dmv2u.oregon.gov​ to verify your eligibility and learn what you’ll need to do to restore your full driving privileges.

What is an Ignition Interlock Device (IID)?

An Ignition Interlock Device (IID), also called a car breathalyzer, is a device that measures breath alcohol content (BrAC). It is typically installed in your vehicle as part of an administrative or legal requirement after drunk driving. Learn more about Smart Start's Ignition Interlock here.

How do I know if Smart Start’s devices are compliant with my program?

What happens after I get my DUII?

In Oregon, the charge of Driving Under the Influence of Intoxicants is commonly referred to as a DUII. Effective January 1, 2016, all people charged with a DUII in Oregon must be booked. This is either done at the time of arrest or prior to your first court hearingAn Oregon driver charged with a DUII will need to contact the Oregon Department of Motor Vehicles (DMV) within the first 10 days to request a hearing pertaining to his/her license suspension. The request must be in writingFailure to request a hearing within the 10-day period will result in you losing your right to a hearing. 

Do I need the device on all of my vehicles?

Oregon law requires an individual with an Ignition Interlock requirement to install an Ignition Interlock Device (IID) on any vehicle that the person plans to drive. If you’re only planning to drive one vehicle, then you will only be required to have a device installed on that particular vehicle. If you plan to drive an additional vehicle, then you would be required to install an Ignition Interlock Device (IID) on that vehicle as well. 

What if I have a requirement, but I don’t own a vehicle?

Oregon state law requires you to install an Ignition Interlock Device (IID) on any vehicle you plan to drive. If you are not planning to drive a vehicle, or you do not own a vehicle, then no IID can be installed. We would suggest that you notify the Oregon Department of Motor Vehicles (DMV) or court that you do not plan to drive and wait for further instructions from your state authority. 

How do the consequences differ for a first and second DUII? Third? Fourth?

For your first DUII in Oregon, you may qualify for a Court Diversion Program. If you meet the terms of the Diversion (including a requirement to install an IID on any vehicle you drive), your DUII offense will be expunged from your record. Additional consequences are as follows:

  • Second DUII: A second offense will require an Ignition Interlock for 24 months.

When the device enters an early recall, there is an additional fee for the reset service. 

What constitutes a violation in my state?

In Oregon, a violation is defined as: 
  • Any test result where the individual blows a BrAC above .020 
  • Failure to take a random re-test 
  • Failure to pass a random re-test 
  • An attempt to tamper with the Ignition Interlock, the camera, or any other component of the device. 

How do I know if I need a camera/GPS/etc.?

Ignition Interlock Devices in Oregon are equipped with a camera and GPS. Digital images and GPS coordinates are stored at the time of each test sequence and are made available to the Oregon State Police (OSP) for Interlock circumvention and tampering investigations. Interfering with either the camera or GPS may result in an extension to your IID requirement period. 

What do I need to bring to my installation appointment?

Once you have scheduled your Ignition Interlock Device (IID) installation with Smart Start, you will need to bring a court order to install an Ignition Interlock Device (IID) or an order from the Oregon Department of Motor Vehicles (DMV) to install an IID. You should be prepared to provide payment for your first month’s lease with a credit or debit card. Also, bring a photo ID and proof of residence to verify your address. 

What should I bring back to my state authority after my device is installed?

You will be provided with a receipt of installation when the Ignition Interlock Device (IID) is installed in your vehicle. This receipt will also have the date when you must return to the shop for the next scheduled Ignition Interlock Device calibration. 

What do I need for removal?

If an Ignition Interlock Device (IID) is required because of a conviction of Driving Under the Influence of Intoxicants or a Diversion Agreement, the IID requirement will remain in effect until the Oregon Department of Motor Vehicles (DMV) receives a No Negative Report from Smart Start. This report will certify that no incidents have been recorded in the last ninety (90) consecutive days prior to the end date of the IID requirement.  As part of a Diversion Agreement, you may petition the court for an early removal of the IID requirement. To be eligible, you must receive a No Negative Report from Smart Start certifying that no incidents have been recorded for six (6) consecutive months. Early removal of the IID requirement is not guaranteed and is at the discretion of the court.
